Limitation of Liability; Non-Excludable Rights

To the maximum extent permitted by applicable law, Tabbylit and its affiliates, and each of their respective directors, officers, employees, agents, contractors, licensors, suppliers, successors, and assigns, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, loss of revenue, loss of business, loss of life, loss of opportunity, loss of goodwill, loss of anticipated savings, loss or corruption of data, or business interruption, arising out of or relating to the purchase, sale, delivery, use, misuse, or inability to use any product or services, whether based in contract, tort (including negligence), statute, equity, or otherwise, even if advised of the possibility of such loss.

To the maximum extent permitted by applicable law, the total aggregate liability of Tabbylit arising out of or relating to any claim, product, service, order, or transaction will not exceed the amount actually paid by you to Tabbylit for the specific product or service giving rise to the claim.

Nothing in this clause or in this Agreement excludes, restricts, or modifies any right, remedy, guarantee, condition, or warranty that cannot lawfully be excluded, restricted, or modified under applicable law, including any non-excludable rights under consumer protection legislation. Where any such law permits liability to be limited but not excluded, Tabbylit's liability will be limited to the maximum extent permitted by law.

If you are acquiring goods or services for business purposes, and to the extent permitted by applicable law, you agree that any consumer protection legislation that would otherwise apply to this Agreement is excluded.

The exclusions and limitations in this clause apply regardless of the form of action and survive termination or expiry of this Agreement.
